Terms of Use

These Terms of Use govern your access to www.hilkemproperties.com and the HilKem tenant portal (together, the "Platform"), operated by HilKem Luxe Homes ("HilKem," "we," "us," or "our"), Matasia, Kajiado County, Kenya. By using the Platform you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Platform.

• Public website — browse our homes, view photos and amenities, and enquire about availability or schedule a viewing.
• Tenant portal — a private area where current tenants can view their lease summary, payment history, notices, and documents, and submit maintenance requests.

Portal accounts are created by our management for current tenants — there is no public signup.

The Platform is not a contract. Any tenancy with HilKem is created and governed solely by the written tenancy agreement signed on paper by you and the landlord. Nothing on the Platform — including lease summaries, payment histories, or printable documents — modifies, replaces, or supplements that agreement. If information on the Platform ever conflicts with your signed tenancy agreement, the signed agreement prevails.

We keep listings accurate, but photographs, descriptions, amenities, and rent amounts are provided for general information and may change. A listing is not an offer capable of acceptance online; availability is only confirmed by our management, and a unit is only secured by a signed tenancy agreement and the payments it specifies.

• Rent and deposits are payable through the channels stated in your tenancy agreement (e.g., M-Pesa or bank transfer) — the Platform itself does not process payments.
• Payment records shown in the portal are an administrative convenience. Official receipts are issued by management; if a portal figure looks wrong, contact us and we will reconcile it.
• Never pay rent to any account or till number other than those stated in your tenancy agreement or official receipts. Verify any change of payment details with management directly before paying.

• Keep your sign-in credentials confidential; you are responsible for activity under your account.
• Tell us immediately if you suspect unauthorised access — we can reset access at any time.
• Accounts belong to the named tenant and may not be shared or transferred.
• We may suspend or close portal access when a tenancy ends or these Terms are breached; doing so does not affect rights under your tenancy agreement.

You agree not to:

• Attempt to access accounts, records, or systems that are not yours
• Probe, scan, overload, or otherwise interfere with the Platform's security or operation
• Submit false enquiries, false maintenance reports, or impersonate any person
• Copy, scrape, or republish Platform content in bulk
• Use the Platform for any unlawful purpose

The HilKem name, monogram, photographs, and all Platform content are owned by or licensed to HilKem Luxe Homes. You may view and print content for personal, non-commercial use (for example, your own documents from the portal); any other reproduction requires our written permission.

Our collection and use of personal data is described in the Privacy Policy, which forms part of these Terms.

The Platform is provided "as is" and "as available." We do not warrant that it will be uninterrupted or error-free. To the maximum extent permitted by Kenyan law, HilKem is not liable for indirect or consequential loss arising from use of the Platform.

Nothing in these Terms excludes liability that cannot be excluded under Kenyan law, and nothing limits either party's rights or obligations under a signed tenancy agreement.

We may update the Platform and these Terms from time to time. The "Last Updated" date above shows the current version; material changes will be notified to tenants through the Platform or by email. Continued use after a change takes effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the Republic of Kenya, and the courts of Kenya have jurisdiction over any dispute arising from use of the Platform. Disputes under a tenancy agreement are handled as that agreement provides.
